1. Acceptance of Terms
By accessing and using the Lapdeal platform (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Lapdeal Pvt. Ltd. If you do not agree to these Terms, you may not use the Service.
2. Valuation and Offers
The initial quotation provided through our online pricing engine is an estimate based solely on the condition parameters you select. This estimate does not constitute a binding offer to purchase. A binding offer is only made after a physical inspection of the device by an authorized Lapdeal agent.
We reserve the right to revise the offer or decline the purchase entirely if the physical condition, functionality, or specifications of the device differ from your digital declaration.
3. Ownership and Title
By offering to sell a device to Lapdeal, you warrant that you are the sole and lawful owner of the device, and that the device is free from any liens, encumbrances, or claims. You further warrant that the device is not stolen or obtained through fraudulent means. You agree to indemnify and hold Lapdeal harmless against any legal actions arising from disputes over device ownership.
4. Data Responsibility
It is strictly your responsibility to back up any personal data and remove any SIM cards, memory cards, or accounts (including iCloud, Google Accounts, or BIOS passwords) before handing over the device. Lapdeal is not liable for any loss of data, unauthorized access to data remaining on the device, or loss of removable media.
While our agents perform secure data wipes pursuant to our operational protocols, Lapdeal assumes no legal liability for data breaches resulting from the user's failure to sanitize the device prior to sale.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Lapdeal Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Service.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.
